Terms of Service

1. Agreement to these terms

These Terms of Service ("Terms") govern your access to and use of the Playback macOS application, website, and related services (together, the "Service"), operated by Kyle McLaren ("we", "us", or "our"). By downloading, installing, or using the Service, you agree to be bound by these Terms.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization.

2. Your account and license

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use Playback for its intended purpose. A paid plan grants the license associated with that plan for as long as it remains active.

• You are responsible for keeping your license key and account credentials secure.
• You may not sell, sublicense, rent, or redistribute the Service or your license.
• You may not reverse engineer, decompile, or attempt to derive source code except where that restriction is prohibited by law.

3. Acceptable use

You agree to use the Service lawfully and to respect the rights of others. You are solely responsible for the content you record, edit, and export.

• Do not record or capture content you do not have the right to capture.
• Do not use the Service to infringe intellectual property, privacy, or publicity rights.
• Do not attempt to disrupt, overload, or gain unauthorized access to the Service or its infrastructure.

4. Your content

Recordings and edits you create with Playback are yours. We do not claim ownership of your content. Because Playback processes recordings on your device, we do not receive or store your recordings unless you explicitly use a feature that uploads them.

You are responsible for maintaining your own backups of anything you value.

5. Payments and refunds

Paid plans are billed through our payment processor. Prices, plan features, and billing intervals are described at checkout. Taxes may apply based on your location.

If you are unsatisfied, contact us within 14 days of purchase and we'll review a refund in good faith, except where prohibited by law.

6. Disclaimers and limitation of liability

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement.

To the fullest extent permitted by law, Kyle McLaren will not be liable for any indirect, incidental, or consequential damages, and our total liability for any claim will not exceed the amount you paid us in the twelve months preceding the claim.

7. Termination

You may stop using the Service at any time. We may suspend or terminate access if you materially breach these Terms or use the Service in a way that risks harm to others. Provisions that by their nature should survive termination will survive.

8. Changes to these terms

We may update these Terms from time to time. When we make material changes, we'll update the date above and, where appropriate, provide additional notice. Continued use of the Service after changes take effect constitutes acceptance.
